Khaled, el-Masri, a German citizen of Lebanese descent, was abducted in 2003. He was taken to Afghanistan and tortured. However, his was clearly a case of mistaken identity. He sought redress in court.
However, a federal appeals court turned him down unanimously, and the US Supreme Court refused to hear the case. The appeals court's reasoning, detailed in a Washington Post article, states that a trial would expose US state secrets.
With that decision, Anthony Romero of the ACLU compares the US to Third-World dictatorships.
